The widespread use of stimulants among healthy individuals to improve cognition has received growing attention; however, public attitudes toward this practice are not well understood. We determined the effect of framing metaphors and context of use on public opinion toward cognitive enhancement. We recruited 3,727 participants from the United States to complete three surveys using Amazon’s Mechanical Turk between April and July 2017. Participants read vignettes describing an individual using cognitive enhancement, varying framing metaphors (fuel versus steroid), and context of (...) use (athletes versus students versus employees). The main outcome measure was the difference in respondent-assigned level of acceptability of the use of cognitive enhancement by others and by themselves between the contrasting vignettes. Participants were more likely to support the use of cognitive enhancement by others than by themselves and more when the use of enhancement by others was framed with a fuel metaphor than with a steroid metaphor. Metaphoric framing did not affect participants’ attitudes toward their own use. Participants supported the use of enhancement by employees more than by students or athletes. These results are discussed in relation to existing ethical and policy literature. (shrink)

There is one sound that will always be loudest in sports. It isn’t the squeak of sneakers or the crunch of helmets; it isn’t the grunts or even the stadium music. It’s the deafening roar of sports fans. For those few among us on the outside, sports fandom—with its war paint and pennants, its pricey cable TV packages and esoteric stats reeled off like code—looks highly irrational, entertainment gone overboard. But as Erin C. Tarver demonstrates in this book, sports (...) fandom has become extraordinarily important to our psyche, a matter of the very essence of who we are. Why in the world, Tarver asks, would anyone care about how well a total stranger can throw a ball, or hit one with a bat, or toss one through a hoop? Because such activities and the massive public events that surround them form some of the most meaningful ritual identity practices we have today. They are a primary way we—as individuals and a collective—decide both who we are who we are not. And as such, they are also one of the key ways that various social structures—such as race and gender hierarchies—are sustained, lending a dark side to the joys of being a sports fan. Their work is beautiful and important, and I am grateful for the opportunity to witness it and think about it and to consider in particular in its relation to its setting in Los Angeles.In what follows, I want (...) to consider that setting—a city, as Dr. Goeman notes, containing some of "the most expensive real estate properties in the United States," commercial areas officially defined by "colonial encompassing property logics," and marked by "noise and [the] reverberation of mass consumerism" ("Caring for Landscapes 57). My interest will be in putting Dr. Goeman's analysis of these works and the Indigenous artist-activists who create them in dialogue with Jane Addams's diagnosis of the problems of early twentieth-century American urban life in her book The Spirit of Youth and the City Streets. I will suggest that Dr. Goeman's paper illuminates the limitations of Addams's approach to responding to the alienation of modern urban life—which, while rightly critical of the harms of mass consumer culture and the reduction of city life to economic productivity in conditions of industrialization, does not grapple with its own implication in settler colonialism and dispossession, and therefore cannot care for the land or its inhabitants as these artists invite us to do. I will also invite her to reflect on whether Addams's suggestion that play and recreation are essential components of urban human flourishing is borne out in the work of these artists.Jane Addams, in 1909, discussed the problems of urban life in post-Industrial Revolution Chicago in similar terms to those Dr. Goeman uses to describe the contemporary landscape of Los Angeles. The contemporary city, Addams writes, in forgoing spaces for public play, art, creativity, and non-production, has "entered upon a most difficult and dangerous experiment … at the very moment when the city has become distinctly industrial, [End Page 71] and daily labor is continually more monotonous and subdivided" (4–5). In this context, young people are increasingly alienated and isolated, valued solely for the products of their labor, and desperate for social connection. The playfulness and creativity of youth cannot be entirely stifled, yet without clear public spaces or institutions for outlets, young people become easy targets for capitalists who promise pleasure and self-actualization through consumption—of liquor, of fashion, of music, and so on. Of 111 former NFL players' brains examined post-mortem, 110 were found to have the damage associated with chronic traumatic encephalopathy, a brain disease causing serious emotional and behavioral problems—and, often, premature death. An account of the specific ill of Native American mascots—that is, the particular racism of using Native Americans as mascots, as distinct from other racist portrayals of Native Americans—requires a fuller account of the function of mascots as such than has previously been offered. By analyzing the history of mascots in the United States, this article argues that mascots function as symbols that draw into an artificial unity 1) a variety of teams existing over a period of time and thereby (...) 2) a community of individuals who are thus able to use that team as their own symbolic locus of unification. This unification of teams and their concomitant communities is accomplished by appeal to a symbol that facilitates a particular fantasy of collective identity. The usage of Native American mascots is racist not only because it involves stereotypical portrayals of Native Americans, but because it treats Native persons simply as a means to symbolic unification—and not, importantly, as members of the community they thus serve. In other words, in these cases mascots work as unifying signifiers precisely by being the purely instrumental facilitator of a group's collective fantasy of itself. (shrink)

Health care costs and affordability are critical issues to consumers. Just as we assess the coverage impacts of a health reform proposal, we should be able to evaluate how the plan will constrain health care costs: its theory of cost control. This essay provides a framework to assess health reform plans on their theories of cost control, identifying the key policy tools to constrain health care costs organized in a two-by-two matrix across the following dimensions: price vs. utilization and public (...) vs. private payers. It then applies the framework to the Affordable Care Act and the Republican's 2017 legislative efforts to repeal and replace the ACA to identify their general theories of cost control, revealing on the plans' strengths, blind spots, and incoherence. Judith Butler’s influential work in feminist theory is significant for its insight that sexist discourse in popular culture affects the agency and consciousness of individuals, but offers an inadequate account of how such discourse might be said to touch, shape, or affect selves. Supplementing Butler’s account of signification with a Deweyan pragmatic account of meaning-making and selective emphasis enables a consistent account of the relationship between discourse and subjectivity with a robust conception of the bodily organism. An analysis of the (...) popular discourse surrounding Hillary Clinton in the 2008 Presidential campaign demonstrates why this hybrid pragmatic/poststructuralist account is necessary. (shrink)

Human traffickers use various methods to maintain and control their victims, including physical, economic, and psychological restraints. Specifically focusing on the psychological aspect of control, this paper seeks to address the role of religion and how it can be exploited as a tool of coercion. Employing case study methodology, this paper will focus on examples of Islam, House of Judah, and Scientology, and how belief systems facilitated victim coercion. The purpose is threefold: to establish religion as a tool of coercion (...) at the interpersonal level, to examine specific trafficking cases in which religion was the method of coercion, and to discuss the challenge of prosecuting cases in which the act was the result of religious coercion. The placenta invades the adjacent uterus and controls the maternal immune system, like a cancer invades surrounding organs and suppresses the local immune response. Intriguingly, placental and cancer cells are globally hypomethylated and share an epigenetic phenomenon that is not well understood – they fail to silence repetitive DNA sequences that are silenced in healthy somatic cells. In the placenta, hypomethylation of retrotransposons has facilitated the evolution of new genes essential for placental function. In cancer, hypomethylation is thought to contribute (...) to activation of oncogenes, genomic instability, and retrotransposon unsilencing; the latter, we postulate, is possibly the most important consequence. Activation of placental retrotransposon-derived genes in cancer underpins our hypothesis that hypomethylation of these genes drives cancer cell invasion. This alludes to an interesting paradox, that while placental retrotransposon-derived genes are essential for promoting early hominid life, the same genes promote disease-susceptibility and death through cancer. Placental and cancer cells fail to silence retrotransposons that are normally silenced in healthy tissues. This has created new genes that are essential for placental function, yet they are also expressed in cancer. We hypothesize that active retrotransposons are a double-edged sword, contributing both adaptive and deleterious functions to biology. (shrink)

Some provisions of the UN’s Convention on the Elimination of Discrimination Against Women (CEDAW) are clearly important from the perspective of business ethics, particularly those calling for equal rights for women to employment and financial security. Some other provisions of CEDAW are equally as important for ethical business practices and Corporate Social Responsibility (CSR), but are frequently overlooked because of the presumption that they are not strictly business concerns: the rights of women to participation in public life, marriage, and family (...) rights; the rights of rural women to adequate living conditions; and general rights to equality. This chapter will discuss the conceptual commitments that underlie the assumption of a clear demarcation between work and life concerns, and examine the criticisms of this assumption made by feminism. It will, in particular, be interested in: -/- • The public/private distinction • The meaning of “work” or “labor” • The relationship between CSR and care ethics • Fostering a broader understanding of the family or familial relations • Examining the connection between fair wages and work/life integration -/- These discussions suggest that the ability for businesses worldwide to uphold the tenets of CEDAW is dependent upon a reconsideration of the character of the Ideal Worker and a nuanced understanding of the effects of workplace policies on the wider communities in which businesses operate. In particular, though work/life integration is not strictly speaking a “women’s issue,” the ethical and policy considerations addressed herein currently have disproportionately negative effects for women; thus, addressing them is crucial for achieving the aims of gender equality. TarverIn February 2008, Michelle Obama famously said to a gathering of supporters, "For the first time in my adult life, I am really proud of my country." (Associated Press 2008). Her comment was swiftly seized upon by journalists and members of rival political campaigns, who used it to portray Mrs. Obama as "angry" and unpatriotic. In the weeks that followed, (...) Mrs. Obama's undergraduate sociology thesis on black students at Princeton was cited as further evidence of her supposed racial resentment and lack of patriotism, and there were widespread rumors that an audiotape existed of her using the word whitey.1 Around the same time, Fox News ran a headline referring to Mrs. Obama as "Obama's Baby Mama" (Koppleman 2008). Subsequently, there was a concerted effort on the part of Mr. Obama's campaign to "soften" her image through appearances on the shows The View and Paula's Party, and a speech at the Democratic National Convention that highlighted her motherhood and adoration of her husband, and avoided mention of her own career or political work. Despite such efforts, and perhaps in tension with the Obama family's general popularity following Mr. Obama's election, Mrs. Obama was later characterized by a cable news pundit as being reminiscent of "Stokely Carmichael in a designer dress" (The O'Reilly Factor 2009) and thus as a potential political liability for the Obama administration.While some feminists decried the "momification" (Traister 2008) of Michelle Obama as an act of appeasement by an administration that would [End Page 150] capitulate to the oppressive expectations of a public unwilling to find expressions of independent thought or professional ambitions appropriately First Lady-like, other critics noted that Mrs. Obama was being reviled more for daring to suggest that the United States' racial history was far from being strictly historical, opening her to the charge of being an angry Negro—while, ironically, being accused of "playing the race card." Others have pointed out that specific formulations such as "baby mama" are illustrative of the fact that such representations of Mrs. Obama are not easily classifiable as either sexist or racist, but instead draw on both sorts of tropes, as have such familiar representations of black women as promiscuous, or as militant, emasculating mammies.In this article, I consider methodologies for theorizing the function of such oppressions in the public discourses surrounding Michelle Obama, and suggest that a consideration of their manifestations in this context illustrates the need for more complex theoretical tools that can problematize the constitutive effects of such discourse for a multiplicity of subjects. Through parallel analyses of Beauvoir's The Second Sex and Fanon's Black Skin White Masks, I foreground the theoretical pitfall the consideration of sex- or race-based oppressions tends to occasion: the tacit presumption of some ostensibly "neutral" subject whose constitution is inadequately addressed. I suggest, with theorists of intersectionality, that this problem will not be solved merely by the addition of alternative explanatory frameworks (e.g., adding racism to sexism as a discrete phenomenon), since doing so is neither adequately representative of the experience of oppressions nor sufficient to the task of undermining the normative/perverse dichotomy or presumption of generic subjectivity that sustains them. However, I also argue that the work of intersectionality theorists should be taken farther than it has frequently been in the past (which, though given lip service by much of the feminist community, has not always been taken to imply the need for a major methodological shift), extending its insights to offer a critique of foundational subjectivity. Concomitantly, I argue that a failure by feminist philosophers to offer this critique could unintentionally result in the reinscription of the normativity of particular sorts of subjects—which is precisely what theorists of intersectionality have been concerned to call into question. I suggest that an analysis of the discourse surrounding Michelle Obama demonstrates that insofar as the intersectionality paradigm is understood merely to require the interrogation of overlapping oppressions on a given subject or subjects, and thus as leaving uninterrogated the constitutively privileging and subjectivizing effects of oppressive discourse, uses of intersectionality will reiterate... Understanding many white football fans' responses to football players' protests against police brutality requires recognizing the historical and contemporary role of football fandom in managing racial and gendered anxieties. In this article, I analyze three distinct uses of memory by white football fans as they work through the anxiety that results when the sport fails to work in the way they expect. My analysis draws on the opposing views of football taken by the American philosophers Josiah Royce and George Santayana (...) and on contemporary social science research on the behavior of sports fans. I show that contemporary fan hostility to protesting players is consistent with the social ills that have surrounded football since the era of Royce's critique. (shrink)

It is difficult for us to effectively diagnose our current character state such that we can follow Aristotle's advice to aim for the opposite extreme. The law can provide us a general standard, and the household strives to fill in the particular gaps inevitable to laws that must be universal. Neither, however, can ensure a proper diagnosis. Careful attention to Aristotle's discussion of how the medical doctor generates health gives us a model we can apply to Aristotle's discussions of character (...) virtues and vices in Book IV of Nicomachean Ethics. The medical doctor must identify the form of health and its various lacks, must have a sufficiently varied set of images by which to properly grasp these in the varied context of human beings, must attend carefully to the patient's impeded form of health, and must trace this impediment back to some cause on the basis of which she can act to correct the problem. By applying this model, we can more profitably employ Aristotle's discussions of individual virtues in our responsible attempts to diagnose and heal the characters of those who belong to us. Taking seriously Linda Martín Alcoff's suggestion that we reevaluate the extent to which poststructuralist articulations of the subject are truly socially constituted, as well as the centrality of Latina identity to her own account of such constitution, I argue that the discussion Alcoff and other Latina feminists offer of the experience of being Latina in North America is illustrative of the extent to which the relational and globally situated constitution of subjects needs further development in many social-constructionist accounts of selfhood. I argue, however—contra Alcoff—that Michel Foucault's mode of investigating subjectivation, particularly as it is articulated in his later work, has room for just such an account, especially when it is supplemented by postcolonial theory. With this end in mind, I take as a case study the public discourse surrounding Sonia Sotomayor prior to her confirmation as the first Latina woman to serve on the United States Supreme Court, suggesting that an analysis of this discourse (including its position within and contribution to wider discourses of ethnicity, race, gender, and class) shows why the accounts of relational subject-constitution offered by both Foucault and Alcoff are indispensable. In Pragmatism as Transition, Colin Koopman argues for a vision of pragmatism that is at once old and new, seeking to overcome the divide between classicopragmatism and neo-pragmatism through a vision of pragmatism whose central feature is “transitionalism.” Transitionalism, for Koopman, is a thoroughly historicist outlook that is present in all forms of pragmatism, even if not as well thematized as it might have been. Wakefield’s harmful dysfunction analysis asserts that the concept of medical disorder includes a naturalistic component of dysfunction and a value component, both of which are required for disorder attributions. Muckler and Taylor, defending a purely naturalist, value-free understanding of disorder, argue that harm is not necessary for disorder. They provide three examples of dysfunctions that, they claim, are considered disorders but are entirely harmless: mild mononucleosis, cowpox that prevents smallpox, and minor perceptual deficits. They also reject the proposal that dysfunctions (...) need only be typically harmful to qualify as disorders. We argue that the proposed counterexamples are, in fact, considered harmful; thus, they fail to disconfirm the harm requirement: incapacity for exertion is inherently harmful, whether or not exertion occurs, cowpox is directly harmful irrespective of indirect benefits, and colorblindness and anosmia are considered harmful by those who consider them disorders. We also defend the typicality qualifier as viably addressing some apparently harmless disorders and argue that a dysfunction’s harmfulness is best understood in dispositional terms. (shrink)

In ‘Rethinking Disease’, Powell and Scarffe1 propose what in effect is a modification of Jerome Wakefield’s2 3 harmful dysfunction analysis (HDA) of medical (including mental) disorder. The HDA maintains that ‘disorder’ (or ‘disease’ in Powell and Scarffe’s terminology) is a hybrid factual and value concept requiring that a biological dysfunction, understood as a failure of some feature to perform a naturally selected function, causes harm to the individual as evaluated by social values. Powell and Scarffe accept both the HDA’s evolutionary (...) biological function component and its incorporation of a value component. Their proposed ‘new twist’ is to revise the value component: ‘Our proposed definition of disease is as follows: a biomedical state is a disease only if it implicates a biological dysfunction that is, or would be, properly disvalued’. So, they propose that a disorder is a ‘properly disvalued dysfunction’ rather than a ‘harmful dysfunction’, an approach they term ‘thickly normative’ in contrast to the thin normative approach of the HDA. There has been a surge of interest recently in better understanding the ‘harm’ component of the HDA. Powell and Scarffe’s analysis is a helpful contribution to this discussion. We focus here exclusively on their proposal regarding the analysis of the concept of disorder and ignore many important related issues that the authors address, ranging from prioritising resource allocation between disorders and non-disorders to whether the concept of disorder should be replaced by a generic welfarist concept. The resolution of these additional issues depends on first understanding ‘disorder’. The authors’ proposed changes to the HDA also deserve evaluation because the HDA, which has been endorsed by leading nosologists,4 plays an influential role in nosological debate across categories of disorder ranging, for example, from sexual paraphilias5 to psychopathy.6 A basic problem is that Powell and Scarffe misinterpret …. The ACA shifted U.S. health policy from centering on principles of actuarial fairness toward social solidarity. Yet four legal fixtures of the health care system have prevented the achievement of social solidarity: federalism, fiscal pluralism, privatization, and individualism. Future reforms must confront these fixtures to realize social solidarity in health care, American-style.

Out-of-network air ambulance bills are a pernicious and financially devastating type of surprise medical bill. Courts have broadly interpreted the Airline Deregulation Act to preempt most state attempts to regulate air ambulance billing abuses, so a federal solution is ultimately needed. However, in the absence of a federal fix, states have experimented with a variety of approaches that may survive preemption and provide some protections for their citizens.

Despite historic efforts to enact the Patient Protection and Affordable Care Act in 2010, national health reform is threatened by multiple legal challenges grounded in constitutional law. Premier among these claims is the premise that PPACA’s “individual mandate” is constitutionally infirm. Attorneys General in Virginia and Florida allege that Congress’ interstate commerce powers do not authorize federal imposition of the individual mandate because Congress lacks the power to regulate commercial “inactivity.” Stated simply, Congress cannot regulate individuals who choose not to (...) obtain health insurance because they are not engaged in a commercial venture. Several courts initially considering this argument have rejected it, but two federal district courts in Virginia and Florida have concurred, leading to numerous appeals and the near promise of United States Supreme Court review. Cluster randomized controlled trials (cluster RCTs) randomize whole clusters of individuals in testing two or more competing interventions. Here we will present the ethical problems raised by cluster RCTs concerning their effect on inequality. We argue that some inequalities generated by cluster RCTs are larger in scope than those generated from individual RCTs. We also argue that any cluster RCT-generated inequalities, which divide groups rather than individuals, are more problematic in type than the inequalities created in individual RCTs. These concerns (...) should be taken into consideration when designing research at the cluster level, and those conducting the research should consider modified research design strategies in cases where they believe the risk of generating inequalities is large. It is often assumed that graphemes are a crucial level of orthographic representation above letters. Current connectionist models of reading, however, do not address how the mapping from letters to graphemes is learned. One major challenge for computational modeling is therefore developing a model that learns this mapping and can assign the graphemes to linguistically meaningful categories such as the onset, vowel, and coda of a syllable. Here, we present a model that learns to do this in English for strings (...) of any letter length and any number of syllables. The model is evaluated on error rates and further validated on the results of a behavioral experiment designed to examine ambiguities in the processing of graphemes. The results show that the model (a) chooses graphemes from letter strings with a high level of accuracy, even when trained on only a small portion of the English lexicon; (b) chooses a similar set of graphemes as people do in situations where different graphemes can potentially be selected; (c) predicts orthographic effects on segmentation which are found in human data; and (d) can be readily integrated into a full-blown model of multi-syllabic reading aloud such as CDP++ (Perry, Ziegler, & Zorzi, 2010). Altogether, these results suggest that the model provides a plausible hypothesis for the kind of computations that underlie the use of graphemes in skilled reading. (shrink)

Informed by Critical Race Theory, this quantitative study supports civic educators in understanding the role of classroom climate and racial identity in students’ civic engagement during a statewide middle school civics mandate (n = 4707). Findings reveal that students of color experience higher civic engagement and lower civic attitude scores than white-identifying peers, after controlling for school, classroom, and affluence indicators. Students’ perception of whiteness (or perhaps majority status) appeared to correlate with positive civic knowledge and civic attitude, but relative (...) civic inaction. These findings suggest differences in civic outcomes as early as middle school between white-identifying students and students of color. Such differences offer implications for civic education interventions that address not only effective instruction, but civic inequities, students’ perceived agency, and curricular content. (shrink)
